Welcome to The Pageant Wardrobe! These Terms and Conditions of Service ("Terms") govern your use of www.thepageantwardrobe.co.nz (the "Site") and the services offered by The Pageant Wardrobe ("we", "us", "our"). By visiting the Site and/or purchasing from us, you agree to be bound by these Terms, including those additional terms and policies referenced herein and/or available by hyperlink.

We reserve the right to modify and add to our Terms and Conditions as necessary. Any changes will be effective immediately upon posting. You are responsible for ensuring you are aware of the latest Terms and conditions published on our website. Placing an order binds you to the Terms and Conditions described herein.

The Pageant Wardrobe Rental Agreement
The legally binding contract when you purchase a rental with us is The Pageant Wardrobe Rental Agreement/Terms of Service as outlined on this page. We rent our garments as stated in the invoice/rental confirmation/contract for a set period to the Renter listed on this agreement on the following terms and conditions. When you hire from The Pageant Wardrobe, you are purchasing the right to wear one of our garments during your agreed rental period. Only the Renter whose details were provided during booking is legally allowed to wear the rented garment.

Booking Requirements
To place a booking, you must provide a New Zealand phone number, New Zealand home address, and email address. Overseas information will not be accepted. Further identification (Driver's license, passport etc) may be requested for larger value orders. If you are under 18 years of age, your parent or legal guardian must agree to this contract. By renting from The Pageant Wardrobe, you confirm that you are at least 18 years of age or that your parent or legal guardian has agreed to this contract. All prices listed on our site are in New Zealand Dollars (NZD).

Garment Condition
We are a rental company, therefore please be aware our garments are pre-worn and minor signs of wear and tear are to be expected. However, we understand that garments must be in wearing condition, with little damage/staining. Any defects or imperfections that we are aware of will be included in the garment description. No refunds will be offered for renting items with listed imperfections as these have been acknowledged before renting the item. We note significant wear in descriptions and always clean and repair garments before rental. However, minor condition changes can occur between booking and rental. We'll contact you about significant changes or include notes with the garment for minor changes.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or related to these Terms must be resolved through binding arbitration in accordance with the rules of the Arbitration Association of New Zealand.
Changes to Website and Pricing

We reserve the right to modify or discontinue our services, products, or any part of the website without notice at any time. We shall not be liable to you or any third-party for any modification, price change, suspension, or discontinuance of the service.

Prices for our garments are subject to change without notice. We regularly review and adjust our pricing to reflect changes in costs, market conditions, and other factors. If a price change occurs after an order has been placed, the price at the time of order placement will apply.

We shall not be liable for any loss or damage arising from any modification, price change, suspension, or discontinuance of the service, including but not limited to loss of profits, goodwill, use, or data, or intangible losses resulting from your use of the website or inability to use the website.

The price and details of your rental as stated in your invoice/rental confirmation/contract at the time of booking are confirmed and supersede any prior website information. We guarantee the price of your rental as stated in your confirmation, provided the order is not modified.

We regularly make updates to garment condition flaws, prices, and rental guidelines. Users should review our website frequently for the most current information.

It is your responsibility to regularly review our website for any changes to prices, garment details, and renting guidelines before placing an order. By placing an order, you acknowledge acceptance of the prices and terms in effect at that time.

Limitations of Liability

The Pageant Wardrobe holds no liability to you or any third party for any unforeseen circumstances or damages due to errors in information given to us by the renter, resulting in damage to the item, non-delivery, or loss of item.

You (“the renter”) solely hold responsibility for the item during the rental period. If any damage and/or claims are made against you as a result of occurrences that happened while you were responsible for the item, regardless of whether or not they were your own doing or out of your control, you will be held solely responsible for the costs incurred.

The Pageant Wardrobe will not be liable to the Renter or any third party for any damage or loss resulting from any defect in the rented item.

In no event shall The Pageant Wardrobe be liable to you or any third party for any special, incidental, indirect and/or consequential damages, including but not limited to loss of profits, goodwill, use, or data, or intangible losses, resulting from your use of the website or inability to use the website, even if The Pageant Wardrobe has been advised of the possibility of such damages.

By renting from The Pageant Wardrobe, you waive any and all claims, demands, actions and causes of action against The Pageant Wardrobe and its affiliates for any and all damages, liabilities, losses and expenses arising out of or resulting from the rental, including but not limited to any damages, liabilities, losses and expenses resulting from the negligence of The Pageant Wardrobe.

You agree to indemnify and hold harmless The Pageant Wardrobe and its affiliates from and against any and all damages, liabilities, losses and expenses, including but not limited to attorneys' fees, arising out of or resulting from any third-party claim, action or proceeding made or brought against The Pageant Wardrobe by reason of the rental.
Fees and Payments

Payment in full is required at the time of the rental transaction. Customers can make payment online via invoice which will be sent via email. An invoice with a "Pay Now" button powered by Stripe will be sent to the customer, allowing for secure and convenient payment.

Rentals cannot be booked or held prior to payment. We do not hold items prior to payment being received.

By submitting your payment, you authorize us to charge your payment method for the total amount due. You confirm that you are the authorized cardholder or account holder and that the payment information provided is accurate.

Additional fees, including late fees and replacement costs, may be charged, as specified below.

Rental Period and Late Returns

The agreed-upon return date and time for the garment(s) will be clearly stated in the invoice and at the time of booking.

Garments must be returned to the NZ Post in the provided return bag by 2pm on the agreed upon return date. A 5-hour grace period will be granted following the designated return time on the agreed upon return date. Garments returned within this timeframe will not incur late fees. Garments returned after the 5-hour grace period will be subject to late fees, unless prior communication and approval has been granted by our team. To avoid late fees, customers must communicate with us directly regarding any return delays or issues.

A daily late fee of $20 will be charged for each day the garment is not returned after the grace period.

If a late return causes the cancellation of another customer's booking, the renter will be charged the rental price of the garment in addition to the late fees.

If the renter has not returned the rental garment(s) within 10 days after the return date, The Pageant Wardrobe will consider the rental garment(s) a "non-return." In such cases, The Pageant Wardrobe will send an invoice charging the renter the full recommended retail value of the Item(s), minus any late fees already paid.

The Pageant Wardrobe is the legal owner of all rental items at all times. You are simply 'borrowing' the item. Therefore, all rental items MUST be returned on time.

The Renter acknowledges that any breach of the rules stated in the Terms and Conditions authorises The Pageant Wardrobe to seek compensation as further outlined in the full Rental Agreement.
Non-Return and Replacement Fees

If the garment is not returned within 10 days after the agreed return date and time, the renter will be required to pay the full retail price of the garment as a replacement fee.

The Pageant Wardrobe reserves the right to take all steps deemed necessary to receive the applicable compensation required due to breach of the Terms and Conditions outlined in this Rental Agreement, including but not limited to legal action and debt collection.

In circumstances where other rental related fees are warranted (e.g. specialist cleaning costs, late or incorrectly made return fees, repair fees, etc), we reserve the right to take further action when these fees are not paid by their invoiced due date. Methods include but are not limited to debt collection agencies, disputes tribunal, reporting to credit agencies, legal action, and public naming.

Loss and Damage

The renter will be held responsible for any loss or damage to the rental garment (beyond normal wear and tear).

If the hired item is returned with stains or damage, the renter agrees to pay for professional dry cleaning or repairs.
In the case of irreparable damage or loss of the garment, the renter will be required to pay the full recommended retail price.

Collections
-
If any amounts owed are not paid when due, we will initiate collection procedures through a third-party agency at our discretion. The renter agrees to pay all costs and expenses, including but not limited to debt collection agency fees, investigation fees, repossession fees, and legal fees, incurred in the enforcement of this Rental Agreement and the collection of any overdue amount.

If a dispute is escalated to the Disputes Tribunal, the renter will be liable for the application fee and any other costs associated with the tribunal process.

Personal data entered when placing the order may be discreetly used to recover the garment and/or recover compensation through the methods previously discussed (a renter's full name is the only exception to this).

If an invoice, fee or garment return is over 10 working days late/unpaid, the debt, or we have been unable to contact the renter, or we are dissatisfied with the response received, the debt will be submitted to debt collectors. Once submitted the surcharge for collection fees becomes irreversible.

Should a customer have an outstanding debt to us and then place a new order, we reserve the right to not fulfil and cancel the new order. We also reserve the right to keep the new order's payment as compensation for the outstanding debt.

Customers who do not make payment of their debt by the required date and therefore are submitted to our debt collectors waive the right to keep the damaged item even if the debt is finally settled.

Rental costs do not contribute to outstanding debt (including late fees, replacement costs, repairs, cleaning etc).

Legal Action

We reserve the right to take legal action for the recovery of the garment or the value thereof if it is not returned within the specified period.

Force Majeure
-
The company will not be liable for any failure to supply products due to events beyond our reasonable control, including but not limited to fire, flood, earthquake, civil disturbances, theft, crime, strike, lockout, war, or failures in electricity or telecommunications services.

Care of Garments
-
Renters must not wash the garments themselves. All items are to be returned unwashed, as we provide professional dry-cleaning services. Altering the garment in any way is strictly prohibited.

We clean and sanitise all garments before rental to ensure they are hygienic and ready for wear.
-
After the rental period, you must return the garment in the same condition as received, ordinary wear and tear excepted. We will conduct a thorough cleaning and inspection upon return.

If upon inspection, the garment requires additional cleaning or stain removal due to your use, or if there are any damages or stains beyond ordinary wear and tear, you will be liable for the costs of cleaning, stain removal, or repair.

Acknowledgement
By renting a garment(s) from The Pageant Wardrobe, you acknowledge that you have read, understood, and agreed to these terms. The Pageant Wardrobe reserves the right, at its sole discretion, to modify or replace these terms at any time. By continuing to access or use our website and services after those revisions become effective, you agree to be bound by the revised terms.

Refund Policy of The Pageant Wardrobe
At The Pageant Wardrobe, we understand that plans can change, and we strive to be as accommodating as possible. Our refund policy is designed to be fair to both our customers and our business operations.

Cancellation and Refunds
Full Refund: If you need to cancel your rental, please contact us at least 7 days before your scheduled rental start date. You will be eligible for a full refund, less a $15 administration fee.
​
Administration Fee Explained
The administration fee covers the preparation costs incurred for each rental. These preparations include thorough cleaning, garment inspection, and reservation management. When a rental is booked, the garment is reserved exclusively for you, potentially turning away other interested renters. Therefore, the administration fee helps to offset the loss of potential rentals and the costs associated with readying the garment for hire.

No Refund: Cancellations made with less than 7 days’ notice before the rental start date will not be eligible for a refund. Refunds and credits are not offered for the following:

Change of mind, simply not liking the garment, or deciding not to wear the garment.

Fit/sizing related issues.
-
Details about garments which are already pre-described.
-
When rentals have already been shipped or packed for pick up.
-
Flaws which have been described or are within 'expected' rental garment condition.
-
Rentals that arrive late from orders placed less than 5 full working days in advance of the rental start date.
-
If we are unable to facilitate a try on of the garment prior to your event date.
Please review your order carefully and ensure all details are accurate before submitting.

Issues upon Receiving a Rental

We offer refunds for items that are received damaged or stained beyond wearability, provided that we are notified immediately and the garment is returned within 24 hours of delivery. The garment must be returned unworn.

If you choose to wear an item to your event or keep a rental for longer than 24 hours after receiving it, you are considered to have accepted the garment in its condition and waive the right to a refund.

Partial refunds may be offered if a garment is received in a wearable but defective condition with an unlisted flaw beyond the scope of normal/expected rental wear. Please contact us immediately upon receiving if your garment comes with a minor defect or stain that we have not pre-listed. We will assess the situation and determine suitable compensation.

There are no other circumstances where correctly delivered/collected rentals will be refunded. All sales are final except as outlined in this section.
